These Terms govern your use of Gordie, a product operated by The Real Human Project LLC.

Self-service raw video downloads are available with certain memberships, including Studio Membership. Availability of raw downloads may vary by plan.
Generally, no. Except where required by law or expressly stated otherwise, payments are non-refundable. Gordie may choose to provide a refund or credit in individual circumstances.
No. Gordie generally retains raw recordings and paid Deliverables for at least 12 months, but we do not guarantee permanent storage. You are responsible for downloading and retaining copies of content you want to keep.
By creating an account, purchasing a Gordie service, or using Gordie, you (a) acknowledge that you have read and understand these Terms; (b) represent that you are 18 years of age or older; and (c) agree to be legally bound by these Terms.
If you do not agree to these Terms, you may not use the service.
These Terms of Use (“Terms”) govern access to and use of Gordie, a service operated by The Real Human Project LLC (“Gordie,” “we,” “us,” or “our”).
Gordie provides tools and services that may allow users to:
Some Gordie features are free. Other features require a paid membership, an Editing Credit, or another purchase.
Gordie uses a combination of human editing and automated technologies, including artificial intelligence systems, to provide the service.
We may update, add, improve, modify, or discontinue features of the service from time to time.
You must create an account to use certain features of the service.

You are responsible for activity that occurs under your account.
Certain plans may allow multiple authorized users. Team accounts may allow Editing Credits and other benefits to be shared among authorized members of the Team account.
“User Content” includes material you create, record, upload, submit, or provide through Gordie, including:
You are responsible for your User Content.
You agree not to use Gordie to create, record, upload, or submit content that:
You represent that you have obtained any permissions necessary from individuals appearing in your recordings and that they have been informed that recordings may be processed and edited using human editors and automated tools.
Users are solely responsible for content they create, record, submit, distribute, or publish using Gordie.
Gordie's interviewing, editing, formatting, transcription, or technical processing does not constitute review, endorsement, or approval of the content.
Gordie may remove or restrict access to content that violates these Terms, applicable law, or may create legal risk for Gordie.
This may include requesting removal of content from third-party distribution platforms where feasible.
Gordie is not responsible for monitoring user-generated content created using the service.
By using Gordie to record audio or video, you grant Gordie permission to record and process your voice, likeness, and recorded statements for purposes of providing the service.
If other individuals appear in recordings, you represent that you have obtained their permission.
Recordings created through Gordie may include your voice and likeness.
Gordie uses these recordings to provide the services you request, including interviewing, transcription, editing, media creation, storage, and distribution when requested.
Gordie does not create voice clones, synthetic voice models, or digital replicas of users without explicit permission.
Gordie does not use user recordings or media to train public artificial intelligence models.
You retain ownership of the User Content you create or provide to Gordie, including your raw recordings.
You also own the final edited content and other Deliverables Gordie creates specifically for you through the service.
Gordie retains ownership of its software, technology, editing systems, templates, platform, workflows, tools, and other underlying intellectual property. Gordie may also retain ownership of internal production assets and intermediate files that are not themselves your User Content or final Deliverables.
Nothing in these Terms transfers ownership of Gordie's underlying technology or platform to you.
You grant Gordie a non-exclusive, worldwide license to use, process, reproduce, edit, store, host, and transmit your User Content as reasonably necessary to provide the service.

This license exists for purposes of operating and delivering the Gordie service and does not give Gordie permission to publicly promote your content without your permission.
Gordie uses automated technologies, including artificial intelligence systems, to assist with functions such as:
By using Gordie, you acknowledge that your content may be processed by these technologies and by third-party service providers that help us operate them.
GORDIE DOES NOT USE USER RECORDINGS OR MEDIA TO TRAIN PUBLIC ARTIFICIAL INTELLIGENCE MODELS.
An “Editing Credit” entitles you to submit one eligible Gordie interview for Gordie's editing services.
The specific Deliverables included with an Editing Credit are those described to you at the time of purchase or submission. Deliverables may vary by plan, offer, or over time.
Unused Editing Credits roll over and do not expire merely because you cancel your membership. If you cancel a membership with unused Editing Credits, you may continue to use those credits without restarting your membership.
Editing Credits:
If Gordie discontinues the Editing Credit program, we will provide users with outstanding Editing Credits a reasonable opportunity to use them or otherwise address the outstanding credits.
Gordie is designed to provide a streamlined editing service rather than fully customized video or audio production.
We will make reasonable revisions to edited Deliverables upon request.
We may decline revision requests that are excessive, repetitive, outside the scope of the original service, materially change the original content or creative direction, or require substantial additional production work.
Any turnaround times provided by Gordie, including in the service, on our website, or in communications with you, are estimates only. Actual turnaround times may vary based on production volume, complexity, revision requests, and other factors.
Certain Gordie memberships may include self-service access to raw recording downloads. Features and download access vary by plan.
Gordie generally retains raw recordings and paid Deliverables for at least 12 months after they are created or delivered, unless you request deletion or applicable law requires otherwise.
We may retain content for longer, but we do not guarantee permanent storage.
You are responsible for downloading and retaining copies of content you want to preserve.
If a membership that includes self-service raw recording downloads ends, access to that membership feature may end at the conclusion of the paid billing period.
Previously purchased or created Deliverables may remain accessible after cancellation, subject to the storage terms above.
Users may choose to publish or distribute content created through Gordie to supported third-party platforms.
When you ask Gordie to publish or distribute content on your behalf:
Users may request removal of content published through Gordie by contacting hello@gordie.co.
We will make reasonable efforts to remove content from supported platforms, but third-party platforms may have their own policies, systems, and processing timelines.
Gordie will not publicly share, advertise, or promote your recordings or Deliverables without your permission.
We may ask for permission to use clips, excerpts, testimonials, or other content for marketing or promotional purposes.
Permission may be provided in writing, including by email or through the service.
Some Gordie features require a paid membership or other purchase.
The price, features, included Editing Credits, and other benefits applicable to your purchase are those presented to you at the time of purchase.
Unless otherwise indicated, prices displayed by Gordie are in U.S. dollars.
Paid monthly memberships automatically renew each month until cancelled.
By purchasing a recurring membership, you authorize the applicable payment provider to charge the applicable membership fee and any applicable taxes to your selected payment method at the beginning of each billing period until you cancel.
You may cancel your membership at any time. Cancellation takes effect at the end of your current paid billing period, and you will continue to receive applicable membership benefits until then.
For memberships purchased directly from Gordie on the web, you can cancel through your account settings while logged in to Gordie.
For memberships purchased through Apple's App Store or Google Play, that app store processes your payment and manages your subscription. You must cancel through your Apple Account or Google Play subscription settings; Gordie cannot cancel it for you. The Gordie app links you there for convenience. Cancel before your next renewal date.
Purchases made through Apple's App Store, Google Play, or another third-party platform may also be subject to that platform's applicable billing, cancellation, and refund terms.
Except where required by applicable law or expressly stated otherwise, payments made directly to Gordie are non-refundable.
If you cancel a membership purchased directly from Gordie, you will retain applicable membership benefits through the end of your current paid billing period but will not receive a refund for the unused portion of that period.
Purchases made through Apple's App Store or Google Play are subject to the applicable app store's refund policies and processes. Refund requests for those purchases must be submitted to Apple or Google, as applicable.
Gordie may, in its discretion, provide a refund, credit, or other accommodation for purchases made directly from Gordie in individual circumstances. Doing so does not create an obligation to provide the same or similar accommodation in other circumstances.
A payment provider, app store, or financial institution may display or process a charge in a currency other than U.S. dollars.
Currency conversions, exchange rates, taxes, and associated fees may be determined by the applicable payment provider, app store, or financial institution. Gordie does not control those exchange rates or third-party fees.
We may change our prices or membership offerings from time to time.
Price changes to an existing recurring membership will apply prospectively. Where required by applicable law, we will provide advance notice before a new price applies to a future renewal and provide information about how to cancel.

Feedback you provide about Gordie may be used to improve the service.
Gordie may collect and use anonymized or aggregated information derived from use of the service to analyze product performance, improve Gordie, and develop new features.
This information will not identify individual users or their content.
Gordie relies on third-party providers to operate portions of the service. These may include:

Third-party services may have their own terms, policies, and practices. Gordie is not responsible for the independent policies or actions of third-party services.

We will make reasonable efforts to process deletion requests, subject to information we may need or be permitted to retain for legal, security, billing, fraud-prevention, or other legitimate business purposes.
Gordie provides interviewing, recording, editing, media, and related services.
We do not guarantee any particular audience, reach, engagement, search ranking, business result, professional outcome, or other result from using Gordie or publishing content created through Gordie.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GORDIE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GORDIE AND THE REAL HUMAN PROJECT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SERVICE.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO GORDIE DURING THE TWELVE MONTHS PRIOR TO THE CLAIM.
You may stop using Gordie at any time.
We may suspend or terminate access to the service if you violate these Terms, misuse the service, create legal or security risk, or fail to pay amounts due.
Termination or cancellation does not eliminate rights or obligations that by their nature should continue after termination, including ownership provisions, payment obligations already incurred, limitations of liability, and your right to use valid unused Editing Credits as described in these Terms.
We may update these Terms from time to time.
If we make a material change that affects an existing paid membership, we will provide notice where required by applicable law.
The updated Terms will be posted with a revised “Last Updated” date.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.
